This is your opportunity to find out more about the court case and recent ruling by the Judge and to ask us questions.
We would also like to hear your views on how we should move forward.
You may have read in the press that the county council has ‘won’ the case. This is not factually correct. What is correct is that:
- By arguing technical points (that we were out of time and that we were not an Economic Operator), GCC have avoided answering the main question as to whether they have broken procurement law.
- CR4C won the argument that we should be allowed to bring a claim 4 years after the contract was signed (an unprecedented judgement) due to the council's refusal to make information public. It was only when it was made public in December 2018 that there was “sufficiently clear and apparent factual indication that the Regulations had been breached” (para 279)”
- The Judge has ruled that CR4C was not an economic operator that could have pre-qualified, but our barrister believes we have firm grounds to appeal.
This is in fact a significant victory for us, and a positive step on a journey that could see up to £150m of illegal State Aid returned to the public purse. Rather than a ‘waste of time and money’ as described by GCC in the press, it is a huge step towards getting value for money for the council and its taxpayers.
Community R4C is seriously considering appealing the Judge’s ruling, and we want to explain the issues to you and hear your views on whether to take this action. We also already have sufficient evidence to move forward on our main aim to recover illegal state aid from UBB; and to pressurise the council’s auditors (Grant Thornton) to complete their job of assessing the (lack of) Value for Money and the (il)legality of the contract and to issue their findings.
