UPDATE : Community R4C vs Gloucestershire County Council – back in court 24th June
Dear Members, Supporters and Friends,
We hope you and yours are well and have coped with the Coronavirus lockdown as best you can. It’s been a strange time for us all and one where the importance and impact of the pandemic seems to have sidelined almost all other news (except perhaps, recently, #blacklivesmatter).

The long radio silence from our side about the Javelin Park incinerator has mainly been due to the impact of Covid-19 on the ability of the law courts to deal with cases.

Back in court
Nevertheless we are now due back in court on 24th June. This is the culmination of what is still the preliminary hearing to decide if there is a case for GCC to answer. Closing statements have already been made in writing but both sides will also make their verbal submissions and this may last all day. The judge could decide on the day or he could go away and prepare his judgment and announce it at a later point.
The hearing will be online. Please let us know ASAP if you want to be able to observe the hearing ‘virtually’ online via videolink. We are currently waiting to hear whether and how this will be possible.

What next?
Let’s not forget why we are doing this: we want an end to harmful incineration in our county and to save taxpayer money in the process. This case is an important potential step to establishing that there has been illegal State Aid of up to £150 million. Illegal State Aid has to be repaid to the state (in this case the County Council) by the group that benefits (so UBB and its backers) This could see a rebate to GCC of illegal State Aid paid to date, perhaps £50m, together with a reduction in forward costs of perhaps £5m per annum.
This refund to Gloucestershire County would go a long way to supporting important services for all taxpayers, services which are all the more important because of COVID-19. We can also expect that this will be major step to achieving the end of harmful incineration in the County, and promoting a greater respect for our environment, resources and health.
