Welcome to our latest edition of the GANADO Shipping and Maritime Law Newsletter, the last one for year 2016.

In this issue, we are pleased to launch the first video as part of a new series aimed at updating our followers on interesting shipping matters through video communication.

We report on the Maritime Labour Convention amendments to protect seafarers against abandonment, the introduction of European maritime spatial planning and Malta’s first ever international Maritime Summit, that was held in October. We also report on GANADO Advocates’ recent involvement in the Sale of m.y. Free Wings and its registration with the Malta Flag, the appointment of Dr Daniel Aquilina as Chairman of Malta Marittima Agency and the visit of a group of young lawyers to GANADO Advocates’ offices in Valletta, as part of a study tour to Malta.

GANADO Advocates hosts young lawyers on study tour from Erasmus University Rotterdam

A group of young lawyers from Erasmus University Rotterdam visited GANADO Advocates’ offices in Valletta on the 18th of October as part of a study tour to Malta and Piraeus, to gain experience of the maritime sector through a practical legal lens. The GANADO Advocates´ Shipping team provided an enthusiastic and appreciative audience with a tailored familiarisation visit and networking sessions as well as valuable insights to the department´s day-to-day work.

GANADO Advocates assists in the Sale of m.y. Free Wings

GANADO Advocates has been actively involved in the conclusion of a deal concerning the sale of the 30 metre sailing yacht ‘Free Wings’ formerly ‘Alas Libres’ and its registration with the Malta Flag.


Dr Daniel Aquilina appointed Chairman of Malta Marittima Agency

Dr Daniel Aquilina, the Partner heading GANADO Advocates’ Ship Finance and Aviation practice areas, has been appointed as the new Chairman of Malta Marittima Agency.



Legal Notice transposing 2014 Maritime Labour Convention amendments published in Government Gazette

On the 25th of November 2016, Legal Notice 390 of 2016 titled the Merchant Shipping (Maritime Labour Convention) (Amendment) Rules 2016, was published in the Government Gazette. The Amendment Rules are to be read and construed as forming part of Legal Notice 145 of 2013 i.e. the Merchant Shipping (Maritime Labour Convention) Rules, and successfully transpose into Maltese law the 2014 Amendments to the Code of the Maritime Labour Convention issued by the International Labour Organisation (ILO).

Malta hosts its first ever Maritime Summit

With a maritime culture and industry steeped in history, an ever growing global maritime presence and its upcoming tenure of the presidency of the Council of the European Union in January 2017, Malta successfully hosted the first Malta Maritime Summit, in Valletta, between the 3rd and the 6th of October.


Introduction of European maritime spatial planning in the Maltese legal framework

EU Directive (2014/89/EU) establishes a framework for maritime spatial planning which came into force on 17 September 2014 and defines maritime spatial planning as “a process by which the relevant Member State’s authorities analyse and organise human activities in marine areas to achieve ecological, economic and social objectives.”
