MoJ Consults on Charging for Tribunal Appeals

Just as this first edition of FOIMan News was going to press, news came in that the Ministry of Justice was consulting on charging for appeals to the First Tier Tribunal (Information Rights). Following on from last week's announcement of an FOI Commission, this is another step that could significantly affect the effectiveness of freedom of information in the UK. 11KBW's Chris Knight provides more details and explains the significance of this move in a blogpost on the Panopticon Blog.

  1. An FOI Commission has been established to review how effectively public interest, safe space and cost burdens are managed in relation to FOI requests under the UK Act. At the same time, responsibility for FOI has passed from the Ministry of Justice to the Cabinet Office. The membership and aims of the Commission have been widely criticised. The Commission is due to report in November. FOIMan comments here.
  2. The Information Commissioner has new powers to enforce the Re-use of Public Sector Information Regulations. The old 2005 regulations have been updated and now require most public bodies to allow re-use of information they disclose or publish, for example through FOI. Steve Wood of the ICO has blogged about the new rules and the ICO’s new guidance on the regulations can be found here.
  3. The Information Commissioner launched his annual report for 2014/15, highlighting new powers under the Data Protection Act and Privacy and Electronic Communications Regulations.
